Terms of Use

The terms that apply when you use this website, book an appointment, or commission or purchase a piece from C'Garden Jewellery.

This website is operated by C'Garden Jewellery ("C'Garden", "we", "us"), a bespoke fine jewellery atelier at The MET Corporate Towers, Kuala Lumpur, Malaysia. By using this website, booking an appointment, or placing an order with us, you agree to these terms. Please read them together with our Privacy Policy and our Returns & Exchanges policy, both of which form part of these terms.

1. Using this website

You may browse this website, save pieces to a list and send us an enquiry for your own personal, non-commercial use. You agree not to misuse the website, attempt to gain unauthorised access to it, interfere with its operation, or use it in any way that is unlawful or that infringes anyone's rights.

We may update, suspend or withdraw any part of the website at any time without notice. We do not guarantee that the website will be available without interruption or free of errors.

2. Intellectual property

Every drawing, design, photograph, rendering, video, text and mark on this website, including the C'Garden name, wordmark and monogram, belongs to C'Garden or is used with permission. Designs created for a client remain the intellectual property of C'Garden even after the finished piece is delivered, unless we agree otherwise in writing.

You may not copy, reproduce, publish, distribute or create derivative works from any content on this website, or use our designs as a reference for manufacture elsewhere, without our prior written consent. Sharing a link to a page, or sharing a page through the share tools we provide, is welcome.

3. Product information and pricing

Every piece we make is finished by hand, and each one is slightly different. Photographs and renderings on this website are as faithful as we can make them, but colour, scale and surface texture will vary between screens and between pieces. Approximate weights, dimensions, stone specifications and lead times are given in good faith and may vary within normal workshop tolerances.

Prices are quoted in Malaysian Ringgit (RM). Because gold and diamonds are priced on live markets, prices on this website and in written quotations are indicative until confirmed in an order. A confirmed quotation is valid for the period stated on it, and otherwise for seven days. Prices include any applicable Malaysian tax at the rate in force on the date of invoice, unless the quotation says otherwise.

Where a piece is shown as "Price on enquiry", a quotation will be prepared for you after consultation. We may correct pricing or descriptive errors on the website at any time, and we are not obliged to sell a piece at an incorrect price.

4. Enquiries, appointments and orders

Sending an enquiry list, booking an appointment or asking for a quotation does not create an order. An order is formed only when we have confirmed it in writing (by email or WhatsApp) and, where a deposit is required, when that deposit has been received.

Consultations at the atelier are complimentary and carry no obligation to purchase. Appointments are held for fifteen minutes past the booked time. Please tell us in advance if you need to reschedule.

We may decline or cancel an order at our discretion, for example where a piece cannot be made to the requested specification, where payment is not received, or where we suspect fraud. If we cancel an order for a reason that is not your fault, any payment you have made for that order will be refunded in full.

5. Bespoke commissions

A bespoke commission follows the path described on this website: consultation, drawing, approval, making, and collection. The design you approve, together with the written specification (metal, purity, stone details, size and finish), defines what we will make. Changes after approval may affect the price and the lead time, and changes after making has begun may not be possible.

A deposit of fifty per cent of the agreed price is payable when the drawing is approved, and the balance is payable before collection or dispatch. Deposits on bespoke commissions cover materials and bench time and are non-refundable once making has begun. Where a commission is cancelled before making has begun, we will refund the deposit less any costs already incurred on your behalf, such as stones sourced to order.

Lead times quoted for bespoke work run from the day the drawing is approved and the deposit is received. We quote lead times honestly rather than optimistically, but they are estimates, not guarantees, and may be affected by stone sourcing, casting schedules and quality checks.

6. Payment

We accept bank transfer, major credit and debit cards, and cash at the atelier. Title to a piece passes to you when we have received payment in full. We may hold a finished piece at the atelier until the balance is settled. Pieces not collected within ninety days of our notice that they are ready may incur a storage charge or, after further notice, be treated as abandoned.

7. Delivery and collection

Pieces may be collected from the atelier or dispatched by insured, tracked courier. Delivery estimates by region are shown on each product page and are estimates only. Risk in a piece passes to you on collection, or on delivery to the address you give us. Please inspect any delivery on receipt and tell us within forty-eight hours of any damage or discrepancy.

For deliveries outside Malaysia, import duties, taxes and customs charges at the destination are your responsibility. We cannot control customs delays.

8. Care, resizing and aftercare

Every piece leaves the atelier with care guidance. Aftercare services (cleaning, re-polishing, resizing, repairs) are provided on the terms set out on the product page and in our Returns & Exchanges policy. Damage caused by wear, accident, misuse, chemicals or work carried out by another jeweller is not covered by any complimentary service.

9. Our liability

Nothing in these terms limits any right you have under the Consumer Protection Act 1999 or any other law that cannot be excluded. Subject to that, our total liability in connection with an order is limited to the price paid for that order, and we are not liable for any indirect or consequential loss. We are not responsible for delays or failures caused by events outside our reasonable control.

10. Third-party links and services

This website may link to third-party sites and services, including Instagram, Facebook and WhatsApp. We do not control those services and are not responsible for their content or their handling of your data.

11. Governing law

These terms are governed by the laws of Malaysia, and any dispute will be subject to the exclusive jurisdiction of the courts of Malaysia. If any part of these terms is found to be unenforceable, the rest continues to apply.

12. Changes to these terms

We may revise these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.
